Note: This Contest is open to residents in the 50 United States (except Hawaii) and the District of Columbia only over the age of 18. Do not enter this Contest if you are not located in the U.S. at this time.
OFFICIAL RULES. NO PURCHASE NECESSARY.
These rules apply to the Starbucks DT Crossword Puzzle Contest ("Contest") being conducted by Starbucks Corporation, 2401 Utah Ave. South, Seattle, WA 98134 ("Sponsor"), and administered by Marden-Kane, Inc., 36 Maple Place, Manhasset, NY 11030 ("Administrator"). This Contest starts February 19, 2006 with the final puzzles to be distributed on March 26, 2006.
1. How to Enter: Purchase the Sunday New York Times with the special Starbucks Discovery Times Crossword puzzle insert available only at participating Starbucks stores starting on February 19, 2006, and each week thereafter through March 26, 2006. No purchase is necessary; You may obtain a free puzzle (only one per week) by sending a separate # 10 self-addressed stamped envelope (“SASE”) for each weekly puzzle that you are requesting with 39¢ postage affixed to each individual SASE to: Starbucks DT Crossword Puzzle Contest, P.O. Box 2017, Grand Rapids, MN 55745-2017. Residents of VT only may omit return postage. You may request more than one week’s puzzle at a time but each week’s puzzle will be mailed back to you in its own SASE. With the week number six puzzle you will receive one additional puzzle, plus all necessary information available in the NY Times to assist you in your pursuit to finding the correct answer. Indicate in the lower left hand corner of each of the SASE envelopes which week’s puzzle you are requesting. All requests must be postmarked no later than March 20, 2006 and received by March 27, 2006.
CAUTION: Read the directions for each of the puzzles very carefully before completing each of the puzzles*. To enter the Contest and to determine the correct answer to the final question, you will first need to have correctly completed the tasks to obtain the trivia questions in puzzles # 1 through #5 and correctly completed puzzle #6. There will be one additional puzzle to solve, revealed by puzzle #6. By themselves the puzzles will not contain enough information to complete the treasure hunt. You will still need additional clues that will be disclosed to you in the regular edition of the March 26th issue of the Sunday New York Times.
*All puzzles for this contest have been edited by Will Shortz of the New York Times whose decisions are final and binding in all matters relating to the Contest.
When you have solved the treasure hunt and the answer to the question, you must call 1-866-801-0112 on April 4, 2006 after 1:00PM Central Daylight Time (“CDT”). Any callers who call in with the correct answer within five [5] minutes of the first caller will be deemed tied and eligible to participate in the tie breaker puzzle. The five minute count down will begin when we receive the first call. If there are a number of callers online during the first five [5] minutes to record their answer to the question, Sponsor shall extend the time for such duration, in its sole discretion, as it deems necessary to accept additional calls up to a maximum of 750 calls or twenty minutes, whichever comes first. You will be prompted to leave your name, and telephone number and the answer to the question. To avoid any possible confusion as to your responses, your call will be recorded. If you are the first person to call in on April 4, 2006 after 1:00PM CDT with the correct answer and no one else calls in within the five [5] minutes, you will be contacted by the Administrator and declared the potential grand prize winner pending compliance with these official rules and receipt by the Administrator of the affidavit of eligibility/liability release, properly executed, within 14 days of issuance winner notification. If more than one person has correctly solved the treasure hunt and called-in their answer to the question within the allotted time (either five [5] minutes or longer), each person will be required to complete another puzzle (edited by Will Shortz). The Administrator will call all those entrants who are tied on April 5, 2006 between the hours of 10:00AM and 3:00PM CDT with the specific website address and time where the tie-breaker puzzle will be revealed. If the entrant is not at home a message will be left on the entrant’s answering machine or with the person who answers the telephone on behalf of the entrant with the web address of where the tie-breaker puzzle may be found. If the entrant does not have an answering machine or no other person answers the telephone, the Administrator will call back every half-hour until 1:00PM CDT. If the entrant still cannot be reached after 3:00PM CDT, he/she will be disqualified. Entrants must call 1-866-801-0112, within a five [5] minute window starting at 4:00PM CDT on April 5, 2006 with the answer to the puzzle. The five minute count down will begin when we receive the first call. Sponsor, at its sole discretion, reserves the right to use different skill tie breaking techniques at anytime to break any ties until such time that the grand prize and up to five first prizes are awarded.
In the event that no one has called in with the correct answer to the question by 11:59 PM CDT on April 4, 2006 then on April 6, 2006 at 11:00AM CDT additional hints will be revealed on www.starbucks.com/crossword to help the entrants navigate the website and find the answer. Entrants will have 30 minutes to call 1-866-801-0112, where entrant will be prompted to leave your name, and telephone number and the answer to the question. To avoid any possible confusion as to your response, your call will be recorded. If more than one person has correctly answered the question, only those persons who answered the question correctly within the allotted time period will be contacted with an opportunity to break the tie using the same procedure outlined above on April 5, 2006. At the end of this tie-breaking round, if there is still a tie, Sponsor, at its sole discretion, reserves the right to continue the contest using a different skill tie breaking technique to break the tie; or to declare that the first person to call in with the correct answer to the question within the allotted time period will be declared the grand prize winner and the next 5 persons who call in within the allotted time period with the correct answer will be declared the first prize winners. If no one answers the question correctly at the end of the 30 minutes on April 6, 2006, all prizes will be forfeited.
2. Prizes: (1) Grand Prize: Coffee for life. The prize will be awarded in the form of an annuity which will be paid in yearly installments of $1,460 per year for the life of the winner, with no interest. Such annual payment is based on a $4.00 cost of coffee per day for 365 days per year, which is equivalent to $1,460 per year for the life of the winner. Approximate retail value (ARV) of grand prize (based on 18 year old winner) is $73,000. However, actual value of the annuity will depend upon the age of the winner. The grand prize can not be transferred or assigned. The winner may elect to take the cash surrender value of the annuity, which at the time of the writing of these rules (January 26, 2006) is worth $32,000. The winner will also receive a Starbucks Card loaded with $500. Approximate retail value (“ARV”) of the grand prize (based on an 18 year old winner) is $73,500. (5) First Prizes: A Starbucks Card loaded with $500. ARV $500 ea. In the event that less than five [5] entrants have the correct answer to the question, the balance of the first prizes will be forfeited. Winners are responsible for the payment of all taxes and for any other expenses and costs not specifically described above. No prize substitutions, cash equivalent or transfer of prizes permitted, except by Sponsor which reserves the right, at its discretion, to substitute a prize of comparable or greater value. Use of the Starbucks Card is subject to its terms and conditions, as issued by Starbucks or contained on the Card.
3. Eligibility: Contest is open to all legal residents of the fifty (50) United States (except Hawaii), and the District of Columbia who are 18 years or older at time of entry. Employees of Starbucks Corporation, Starbucks Licensed Concepts and Business Alliance partners, Marden-Kane, Inc., The New York Times, Discovery Communications, their respective parent companies, subsidiaries, affiliates, prize suppliers, and advertising and promotion agencies, and the immediate families (spouses, parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the households, whether related or not, of the above are not eligible to enter or win. Void in Hawaii and where prohibited by law. The Contest is subject to all applicable federal, state and local laws and regulations.
4. Winner Notification: The potential winners will be notified by telephone on or about April 7, 2006 followed by written confirmation. If prize notification is returned as undeliverable, the prize will be forfeited and awarded to the entrant with next fastest correct answer. Potential winners may be required to complete and sign an Affidavit of Eligibility/Liability Release, IRS Form W-9, and where legal, a Publicity Release, all of which must be returned within 14 days of issuance of prize notification or prize may be forfeited and, at Sponsor’s discretion, awarded to the entrant with the next fastest correct answer. By entering the Contest, entrants agree to the use of their name and photograph/likeness for advertising and promotional purposes, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law. Upon request, winner will provide consent to such in writing.
5. Limitation of Liability: By participating in the Contest, entrants, or if minors, their parents or legal guardians, agree to release, indemnify and hold harmless Starbucks Corporation, Starbucks Licensed Concepts and Business Alliance partners, Marden-Kane, Inc., The New York Times, Discovery Communications and all their affiliates, subsidiaries, advertising and promotions agencies, and each of their respective agents, representatives, officers, directors, shareholders, and employees (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions, or liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or nonuse of any prize (including any travel related thereto) that may be awarded. Entrants agree that the laws of the state of Washington will govern any and all disputes. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Contest, including, without limitation errors which may occur in the administration of the Contest, the processing of entries, the announcement of the prizes or in any Contest related materials; or for transactions or entries that are lost, stolen, late, misdirected, damaged, incomplete, inaccurate, garbled, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this promotion, or process any transaction thereon. If in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process, void any entries submitted fraudulently, modify or suspend the Contest, or to terminate the entire Contest or that portion of the Contest relating to the suspected or actual tampering of the Contest Should the Contest be terminated or modified prior to the stated expiration date, notice will be posted on www.starbucks.com/crossword. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. As a condition of entering the Contest, participant agrees that: a.) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees. Sponsor reserves the right to modify prize award procedures.
