Starbucks Digital Network Terms of Use

Welcome to the Starbucks Digital Network (http://digital.starbucks.com). Starbucks Corporation and/or its affiliates (“Starbucks”) are providing website features to you subject to the following Terms of Use. If you visit or use the Starbucks Digital Network, you accept these Terms of Use and the Starbucks Privacy Policy. Please read them carefully.

Content Providers

The Starbucks Digital Network is designed to serve as a portal to provide information and links to links to content and sites of affiliated companies, content providers and businesses (including but not limited to Google, Inc.) ( each, a “Content Provider”) that may offer content or services or sell products or subscriptions. Starbucks is not responsible for examining or evaluating, and does not warrant the offerings of any of these Content Providers or the content of their sites and does not assume any responsibility or liability for the content, products, or services of any such Content Provider. The access and use of any sites of Content Providers or offerings content, products or services made available by such Content Providers through the Starbucks Digital Network are subject to the terms of use and privacy statements and conditions of such Content Providers.

License and Access

Starbucks grants you a non-exclusive, revocable limited license to access and make personal use of the Starbucks Digital Network. You are not permitted to download (other than page caching) or modify the Starbucks Digital Network, or any portion of it, except with the express written consent of Starbucks. This license does not include (a) any resale or commercial use of the Starbucks Digital Network or its contents; (b) any collection and use of any product listings, descriptions, or prices; any derivative use of the Starbucks Digital Network or its contents; any downloading or copying of account information for the benefit of another merchant; or (c) any use of data mining, robots or similar data gathering and extraction tools. The Starbucks Digital Network (or any portion of it) may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Starbucks. Any unauthorized use terminates the permission or license granted by Starbucks.

Use of the Starbucks Digital Network

If you are under 18 years old, you may use the Starbucks Digital Network only with the consent of a parent or guardian.

While Starbucks endeavors to ensure that the Starbucks Digital Network is available at all times, Starbucks, in its sole discretion, reserves the right to refuse service, terminate your account, remove or edit content, or revoke access. Starbucks shall not be liable if, for any reason, the Starbucks Digital Network is unavailable to you.

You are prohibited from: (1) using the Starbucks Digital Network to send or post harassing, abusive or threatening messages; (2) transmitting or viewing through the Starbucks Digital Network any information, data, text, files, links, software or other materials that Starbucks considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, hateful, racially, ethnically or otherwise objectionable or which threatens our relationships with our employees, partners, customers or suppliers; (3) attempting to conceal or misrepresent the identity of the sender or person submitting the information or the origin of any content or services; (4) disrupting the normal flow of the Starbucks Digital Network, including, without limitation, any dialogue on the Starbucks Digital Network or otherwise act in a manner that negatively affects other participants or is deemed inappropriate by Starbucks; (5) sending spam or other direct marketing communications or posting, transmitting or linking to any unsolicited advertising, promotional materials or any other forms of solicitation or commercial content; (6) intentionally or unintentionally performing or promoting any activity that would violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the Starbucks Digital Network; (7) posting or transmitting executable programming of any kind, including viruses, spyware, trojan horses, easter eggs or any other form of computer programming; (8) using the Starbucks Digital Network in such a way that damages the image or rights of Starbucks, other users or third parties; and (9) framing or utilizing framing technologies to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form).

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE STARBUCKS DIGITAL NETWORK AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. STARBUCKS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE STARBUCKS DIGITAL NETWORK OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE STARBUCKS DIGITAL NETWORK IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, STARBUCKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. STARBUCKS DOES NOT WARRANT THAT (A) THE STARBUCKS DIGITAL NETWORK; (B) INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK; OR (C) E-MAIL SENT FROM STARBUCKS OR ANY CONTENT PROVIDERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. STARBUCKS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE STARBUCKS DIGITAL NETWORK OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Privacy Policy

In connection with its operation of the Starbucks Digital Network, Starbucks may collect, use and disclose information about you to Content Providers and others. To find out more about the information Starbucks may collect, how Starbucks may use and discloses such information and how Starbucks keeps such information secure, visit the Starbucks Privacy Policy . The Starbucks Privacy Policy does not apply to sites of Content Providers that may be reached via links on the Starbucks Digital Network that display or link to different privacy policies or statements.

Copyright and Trademark Information

All content included on the Starbucks Digital Network, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Starbucks or the applicable Content Provider and is protected by United States and international copyright laws. The compilation of all content on the Starbucks Digital Network is the exclusive property of Starbucks and protected by U.S. and international copyright laws. All software used on the Starbucks Digital Network is the property of Starbucks or its software suppliers and protected by United States and international copyright laws.

Starbucks and the Starbucks logo are registered trademarks of Starbucks. All other trademarks, service marks, domain names, logos, company names and indicia of origin referred to on the Starbucks Digital Network are either the property of Starbucks or the applicable Content Provider. In countries where any of the Starbucks trademarks, service marks, domain names, logos, company names or indicia of origin are not registered, Starbucks claims other rights associated with unregistered trademarks, service marks, domain names, logos, trade name, company names and indicia of origin. Other product or company names referred to on the Starbucks Digital Network may be trademarks of their respective owners. You may not use any trademark, service mark, domain name, logo, company name, trade name or indicia of origin on the Starbucks Digital Network without permission from the owner of the applicable trademark, service mark, domain name, logo, company name, trade name or indicia of origin. You may contact Starbucks by sending an e-mail to Customer Care, or writing to Starbucks at 2401 Utah Ave. S, Seattle, WA 98134 USA, to request written permission to use trademarks, indicia of origin and materials of Starbucks the Starbucks Digital Network for purposes other than stated in these Terms of Use.

Digital Millennium Copyright Act (“DMCA”) Notice

In operating the Starbucks Digital Network, Starbucks may act as a “services provider” (as defined by DMCA) and offer services as an online provider of materials and links to third party websites. As a result, materials that Starbucks does not own or control may be transmitted, stored, accessed or otherwise made available using the Starbucks Digital Network. Starbucks has in place certain legally mandated procedures regarding allegations of copyright infringement occurring on the Starbucks Digital Network that provide for the prompt removal of any content that is found to have infringed on the rights of Starbucks or of a third party, or that has otherwise violated any intellectual property laws or regulations or these Terms of Use.

If you believe any material available via the Starbucks Digital Network infringes a copyright, you should notify Starbucks using the notice procedure for claimed infringement under the DMCA (17 U.S.C. Sect. 512(c)(2)). Starbucks will respond expeditiously to remove or disable access to the material claimed to be infringing and will follow the procedures specified in the DMCA to resolve the claim between the notifying party and the alleged infringer who provided the content. Starbucks may give notice to its users of any infringement notice by means of a general notice on any of its websites, electronic mail to a user’s e-mail address in its records, or by written communication sent by first-class mail to a user’s physical address in its records. If you receive such an infringement notice, you may provide counter-notification in writing to the designated agent that includes the information below.

To be effective, the counter-notification must be a written communication that includes the following: (a) your physical or electronic signature; (b) identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled; (c) a statement from you under the penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and (d) your name, physical address and telephone number, and a statement that you consent to the jurisdiction of a Federal District Court for the judicial district in which your physical address is located, or if your physical address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification of allegedly infringing material or an agent of such person.

Modifications to Terms of Use

Starbucks can revise these Terms of Use at any time by modifying or updating this posting. Your use of the Starbucks Digital Network on or after the effective date of any such modification or update will constitute your acceptance of these Terms of Use as modified and/or updated except where other notices or consent is required by law.

Applicable Law

By visiting the Starbucks Digital Network, you agree that these Terms of Use are governed by U.S. federal law and/or the laws of the State of Washington. Any legal action or proceeding relating to your access to, or use of, the Starbucks Digital Network or these Terms of Use shall be instituted only in a state or federal court located in the state of Washington.
