License and Access
Starbucks grants you a non-exclusive, revocable limited license to access and make personal use of the Starbucks Digital Network. You are not permitted to download (other than page caching) or modify the Starbucks Digital Network, or any portion of it, except with the express written consent of Starbucks. This license does not include (a) any resale or commercial use of the Starbucks Digital Network or its contents; (b) any collection and use of any product listings, descriptions, or prices; any derivative use of the Starbucks Digital Network or its contents; any downloading or copying of account information for the benefit of another merchant; or (c) any use of data mining, robots or similar data gathering and extraction tools. The Starbucks Digital Network (or any portion of it) may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Starbucks. Any unauthorized use terminates the permission or license granted by Starbucks.
Use of the Starbucks Digital Network
If you are under 18 years old, you may use the Starbucks Digital Network only with the consent of a parent or guardian.
While Starbucks endeavors to ensure that the Starbucks Digital Network is available at all times, Starbucks, in its sole discretion, reserves the right to refuse service, terminate your account, remove or edit content, or revoke access. Starbucks shall not be liable if, for any reason, the Starbucks Digital Network is unavailable to you.
You are prohibited from: (1) using the Starbucks Digital Network to send or post harassing, abusive or threatening messages; (2) transmitting or viewing through the Starbucks Digital Network any information, data, text, files, links, software or other materials that Starbucks considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, hateful, racially, ethnically or otherwise objectionable or which threatens our relationships with our employees, partners, customers or suppliers; (3) attempting to conceal or misrepresent the identity of the sender or person submitting the information or the origin of any content or services; (4) disrupting the normal flow of the Starbucks Digital Network, including, without limitation, any dialogue on the Starbucks Digital Network or otherwise act in a manner that negatively affects other participants or is deemed inappropriate by Starbucks; (5) sending spam or other direct marketing communications or posting, transmitting or linking to any unsolicited advertising, promotional materials or any other forms of solicitation or commercial content; (6) intentionally or unintentionally performing or promoting any activity that would violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the Starbucks Digital Network; (7) posting or transmitting executable programming of any kind, including viruses, spyware, trojan horses, easter eggs or any other form of computer programming; (8) using the Starbucks Digital Network in such a way that damages the image or rights of Starbucks, other users or third parties; and (9) framing or utilizing framing technologies to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form).
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE STARBUCKS DIGITAL NETWORK AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. STARBUCKS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE STARBUCKS DIGITAL NETWORK OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE STARBUCKS DIGITAL NETWORK, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE STARBUCKS DIGITAL NETWORK IS AT YOUR SOLE RISK.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, STARBUCKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
Copyright and Trademark Information
All content included on the Starbucks Digital Network, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Starbucks or the applicable Content Provider and is protected by United States and international copyright laws. The compilation of all content on the Starbucks Digital Network is the exclusive property of Starbucks and protected by U.S. and international copyright laws. All software used on the Starbucks Digital Network is the property of Starbucks or its software suppliers and protected by United States and international copyright laws.

Digital Millennium Copyright Act (“DMCA”) Notice
If you believe any material available via the Starbucks Digital Network infringes a copyright, you should notify Starbucks using the notice procedure for claimed infringement under the DMCA (17 U.S.C. Sect. 512(c)(2)). Starbucks will respond expeditiously to remove or disable access to the material claimed to be infringing and will follow the procedures specified in the DMCA to resolve the claim between the notifying party and the alleged infringer who provided the content. Please provide the following: (a) the copyrighted work or other intellectual property that you claim has been infringed; (b) the material on the Starbucks Digital Network that you claim is infringing, with enough detail so that Starbucks may locate it on the Starbucks Digital Network; (c) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; (d) a statement by you declaring under penalty of perjury that (i) the above information in your notice is accurate, and (ii) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner; (e) Your address, telephone number and email address; and (f) Your physical or electronic signature.
Starbucks may give notice to its users of any infringement notice by means of a general notice on any of its websites, electronic mail to a user’s e-mail address in its records, or by written communication sent by first-class mail to a user’s physical address in its records. If you receive such an infringement notice, you may provide counter-notification in writing to the designated agent that includes the information below.
To be effective, the counter-notification must be a written communication that includes the following: (a) your physical or electronic signature; (b) identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled; (c) a statement from you under the penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and (d) your name, physical address and telephone number, and a statement that you consent to the jurisdiction of a Federal District Court for the judicial district in which your physical address is located, or if your physical address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification of allegedly infringing material or an agent of such person.
